1. Acceptance of Terms
By creating an account, joining a session, or otherwise accessing our platform, you confirm that you are at least 18 years of age, have read and understood these Terms of Use, and agree to comply with them. If you are accessing the platform on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Description of Services
Domain provides a virtual group consultation and collaborative learning platform designed to connect clients with service providers for structured group sessions, experience exchange, and facilitated professional development. The specific features and availability of services may change over time at our discretion.
3. User Accounts
3.1 Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at [email protected] if you become aware of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access caused by your failure to safeguard your credentials.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time if we determine, in our sole discretion, that you have violated these terms or engaged in conduct harmful to other users or our platform.
4. Permitted Use
You agree to use our platform only for lawful purposes and in a manner consistent with these terms. You may not use the platform to harass, abuse, or harm other participants, distribute spam or unsolicited communications, attempt to gain unauthorized access to any part of the platform or its underlying systems, upload malicious code or interfere with platform functionality, or misrepresent your identity or affiliation.
5. User Content
5.1 Your Content
You retain ownership of any content you submit, post, or share through our platform, including messages, documents, and contributions made during group sessions. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and display that content solely as necessary to provide and improve our services.
5.2 Content Standards
You agree not to submit content that is unlawful, defamatory, obscene, threatening, or that infringes the intellectual property rights of any third party. We reserve the right to remove any content that violates these standards without prior notice.
5.3 No Endorsement
We do not endorse any user-submitted content and are not responsible for the accuracy, completeness, or reliability of content contributed by participants.
6. Intellectual Property
All platform content, software, design, branding, and materials created by Domain — including but not limited to text, graphics, interfaces, and session frameworks — are the exclusive property of Domain or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our proprietary materials without express written consent.
7. Group Sessions and Participation
7.1 Session Conduct
Participants in group sessions are expected to engage respectfully and constructively. Disruptive behaviour, including but not limited to personal attacks, deliberate derailment of discussions, or violation of session confidentiality agreements, may result in removal from a session and suspension of your account.
7.2 Recording and Confidentiality
Sessions may be recorded for quality and administrative purposes where permitted. Participants must not record, reproduce, or distribute session content without prior written consent from all parties involved and from Domain.
7.3 No Professional Advice
Content shared during sessions is for informational and collaborative purposes only. Nothing presented by facilitators, service providers, or other participants constitutes legal, financial, medical, or other regulated professional advice. You are solely responsible for decisions made based on session content.
8. Payments and Refunds
Certain services on our platform require payment. All fees are stated at the time of purchase. Payments are processed through third-party payment providers and are subject to their terms. Refund eligibility is determined by the specific service agreement applicable to your purchase. We reserve the right to modify pricing with reasonable advance notice. You remain responsible for all applicable taxes associated with your purchase.
9. Third-Party Services and Links
Our platform may contain links to or integrations with third-party websites and services. We do not control and are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms.
10. Privacy
Your use of our platform is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. By using our services, you consent to the collection and use of your information as described in the Privacy Policy. For questions regarding your personal data, contact us at [email protected].
11. Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. You use the platform at your own risk.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Domain and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the platform, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any claims arising under these terms shall not exceed the total fees paid by you to Domain in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Domain and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.
14. Modifications to Terms
We reserve the right to update or modify these Terms of Use at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify registered users by email. Your continued use of the platform after any changes take effect constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must discontinue use of the platform.
15. Termination
Either party may terminate the relationship governed by these terms at any time. You may do so by ceasing use of the platform and closing your account. We may terminate or suspend your access immediately, without notice, for conduct that we determine violates these terms, is harmful to other users, or is otherwise detrimental to the platform. Upon termination, your right to use the platform ceases immediately.
16. Governing Terms
These Terms of Use constitute the entire agreement between you and Domain with respect to your use of the platform and supersede all prior agreements, representations, and understandings. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
